This privacy policy has been compiled to better serve those who are concerned with how their ‘Personally Identifiable Information’ (PII) is being used online. PII, as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website. Additionally, in accordance with the  European (Global Data Protection Regulation) GDPR, the Application and Website are built under the policy of Privacy by Design.

Whilst browsing our site we will collect browsing data if you accept cookies.  If you register for our newsletter, or contact us, you will be asked to enter your name and email address.

Use of ‘cookies’ on the Duckontherungame.com website.

Personal information collected from the people that download the Duck on the Run app.

If the app is played in guest mode, no personal data is collected, although an age is asked for in order to set the game at an appropriate starting level.  If you register for the game, we will ask you for your name, email address, as well as names and ages of players.  This information is collected in order to set up personal user profiles for each player, and ensure the game status is portable between devices.

Additional demographic data is optional, and will be used to assist in analysis of gameplay.  Actions taken within the game will also be logged – specifically the answers given to the mathematical questions asked.  This data and additional demographic data will be analysed in order to better adapt the game to the user base, and drive game improvements.

Use of information

We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, use the app, or use certain other site features in the following ways:

  • To personalize your experience and to allow individual game status to be transferred across devices.
  • To deliver the type of content most appropriate to your playing level and interests through newsletters.
  • To improve our website and app in order to better serve you.
  • To allow us to better serve you in responding to your customer service requests.

Protection of personal information.

Privacy by design separates PII from the anonymized gameplay logs. Our website and app only provide entertainment, articles and information. We never ask for credit card numbers. The website and data stores are hosted by Amazon Web Services, Inc. and utilizes the protection offered by that service. All data is hosted on servers physically located within the European Union.

Third-party disclosure

We do not sell or trade your PII to 3rd parties.  However, external service providers are used to improve our service offering and personalised experiences.  These third party services include:

  • Mailchimp for managing distribution lists for newsletters
  • Google analytics for understanding website traffic
  • Use of facebook pixel to understand the profile of website visitors

We do not include or offer third-party products or services on our website.

California Online Privacy Protection Act

According to CalOPPA, we agree to the following:

  • Users can visit our website anonymously.
  • There is a link to this privacy policy at the base of our home page, and in the hamburger menu. Our Privacy Policy link includes the word ‘Privacy’ and can easily be found on the page specified above.
  • You will be notified of any Privacy Policy changes on our Privacy Policy Page
  • You can change your personal information by logging in to your account and changing the data associated with your account

Do Not Track signals

We honour Do Not Track signals. We do not plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Parents in Control of Data Privacy

When it comes to the collection of personal information from children under the age of 13 years old, we support the Children’s Online Privacy Protection Act (COPPA) and the EU GDPR which places parents in control of their children’s PII.

We collect information from children under 13 for the purpose of enhancing and building their mathematical skills. Marketing is not directly targeted at children under 13, but the messages aimed at their parents or legal guardians may appeal to these children. We do not let third parties, including ad networks or plug-ins collect PII from children under 13. All gameplay data that is accessible by 3rd parties is anonymized within our servers

We adhere to the following COPPA tenants:

  • We will not require a child to disclose more information than is reasonably necessary to participate in an activity.
  • Parents can review their child’s personal information, direct us to delete it, and refuse to allow any further collection or use of the child’s information.
  • Parents can agree to the collection and use of their child’s information, but still not allow disclosure to third-parties unless that’s part of the service.
  • Parents can review, delete, manage or refuse with whom their child’s information is shared directly on the Duck on the Run app or by contacting us directly.
  • We will notify parents directly before collecting PII from their kids. In the current version of the app, it is expected that the parent provides PII data themselves through the parents area when setting up a child. This includes what specific information we want to collect and how it might be disclosed, a link to our online privacy policy, and how the parents can give their consent. Also, if the parent doesn’t consent within a reasonable time, we will delete the parent’s and child’s online contact info from our records.

The GDPR and Fair Information Practices

The GDPR and Fair Information Practices Principles form the backbone of privacy law in the United States  and the European Union.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

  • We will notify the data subjects via our website within 72 hours

We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

GDPR Data Rights

Exercising of all GDPR Data rights will be administered by the Data Privacy Officer. A fee of CHF 20 will be charged if the Data Privacy Officer deems a data access request to be manifestly unfounded or excessive, particularly if it is repetitive. All data subjects exercising their rights, must allow us to verify their identity, and relationship to any minor on behalf of whom they are exercising their data rights.

We will need two copies of forms of identification to verify the identity of the data subject, which can be:

  • Passport
  • Driving licence
  • Birth certificate*
  • Utility bill (from last 3 months)
  • Current vehicle registration document
  • Bank statement (from last 3 months)
  • Rent book (from last 3 months).

*For exercising data rights for minors, we will need a certified copy of their full birth certificate, clearly stating both parent’s names.
